COOLEST COSTUME CONTEST TERMS AND CONDITONS:

Contest Void in where prohibited by law. Contest begins at 12:00 A.M. PT , August 3, 2004 , and all entries must be received by 11:59 P.M. PT , October 13, 2004 . The winner will be selected on or about December 1, 2004 . All times are Pacific Time (PT).

HOW TO ENTER
Go to Coolest Kid Birthday Parties web site, (http://www.coolest-kid-birthday-parties.com/costume-contest) and complete the online submission form or print out the submission form and send by mail to: Shippony – Coolest Costume Contest, PO Box 56193, Sherman Oaks, CA, 91413

Entries must be received by 11:59 P.M. PT, November 13, 2004. Once submitted, entries and photographs become the sole property of Sponsor (Coolest Kid Birthday Parties) and will not be returned .

Sponsor is not responsible for lost, interrupted, or unavailable network, server, or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical, or electronic; including without limitation the incorrect or inaccurate capture of entry information online, or for lost, late, incomplete, damaged, stolen, misdirected, illegible, or postage-due entries or mail. Entry materials/data that have been tampered with or altered are void.

SELECTION OF WINNERS AND JUDGING CRITERIA
All eligible entries will be judged by Sponsor's creative staff. The judges will select fifteen (15) finalists (the "Finalists") from all the eligible entries received. The judging criteria to be used in selecting the Finalists will be (1) 50 percent for creativity and originality of the costume, and (2) 50 percent for the quality of the costume and write up (the "Judging Criteria"). Once the 15 finalists have been chosen, visitors to Coolest Kid Birthday Parties Web site will vote for their favorites. The entry photos and write ups of the Finalists will be posted on the Coolest Kid Birthday Parties Web site on or about November 15, 2004 , through December 3, 2004 (the "Voting Period"). The Web site's visitors will be invited to vote on their favorite entry (based on the Judging Criteria) via an online polling page. The Web site visitors will be eligible to vote only once during the Voting Period. The entry photo that accumulates the most votes during the Voting Period shall be the Grand Prize winner. In the event that there is a tie between two (2) or more of the Finalists, Sponsor's creative staff will select the Grand Prize winner from such tied entries based on the Judging Criteria. Winners will be notified on or about December 10, 2004 , via mail, e-mail. By participating, entrants agree to the Official Rules and the decisions of the judges, which shall be final and binding in all respects.

CONTEST PRIZES
One (1) Grand Prize winner will receive a $150 Gift Certificate at Amazon or BirthdayExpress.com. One (1) Second Prize winner will receive a $75 Gift Certificate for party supplies at BirthdayExpress.com. One (1) Third Prize winner will receive a $50 Gift Certificate for party supplies at BirthdayExpress.com.

Additional prizes may be added upon the Sponsor's discretion.

Winner is solely responsible for any and all taxes on prize, as well as any and all expenses relative to participation in the Coolest Costume Contest (including acceptance of prize) not specified herein. Prizes will be awarded within approximately 60 days after selection of winner. No substitution allowed except at discretion of the Sponsor. Prizes are not transferable. Sponsor reserves the right to substitute any and all prizes with prizes of equal or greater value, if an advertised prize becomes unavailable.

ELIGIBILITY
Contest void where prohibited by law. All federal, state, and local laws and regulations apply.


CONDITIONS OF PARTICIPATION
Winners will be notified by e-mail and must respond within fourteen (14) days of attempted notification or be disqualified. If a prize is returned as undeliverable, potential winner will be disqualified. Sponsor reserves the right, in its sole discretion to cancel, terminate, or suspend the contest should viruses, bugs, unauthorized human intervention, or other causes beyond the control of Sponsor corrupt or impair the administration, security, or fairness of the contest. In such event, winners will be selected from all eligible entries received up to the time of such cancellation, termination, or suspension.

Submission of an entry constitutes the irrevocable grant to Sponsor of all rights in the entry, all rights to publish, use, adapt, edit, and/or modify such entry in any way and in any and all media, without limitation, and without consideration or acknowledgment to the entrant and the unconditional right to use the photograph and statements about the promotion for advertising/publicity purposes without additional compensation, except where prohibited by law.

By entering, participants release Coolest-Kid-Birthday-Parties.com from any and all liability for any injuries, losses, or damages of any kind caused by participation in the contest or the acceptance, possession, or use/misuse of a prize or participation in any prize-related activities.
